NEW YORK (Reuters) – Britain’s Prince Andrew on Friday rejected Virginia Giuffre’s accusations that he sexually assaulted her more than two decades ago when she was 17, and urged a US judge to dismiss her civil claim.

In US District Court filings in Manhattan, the Duke of York called Geoffrey’s “unfounded” lawsuit an attempt to “achieve another payday” of her accusations against Jeffrey Epstein, a registered sex offender, and his associates.

Andrew, 61, Queen Elizabeth’s second son, said he is protected from Joffrey’s allegations under his 2009 settlement agreement with Epstein, saying the late financier insisted he cover “any and all persons” who Joffrey might sue.

Andrew’s lawyers wrote: “Virginia Joffrey may have been the victim of sexual assault at the hands of Jeffrey Epstein, and nothing can fully justify, nor captivate, the aversion and gravity of Epstein’s brutal behavior against Joffrey, if so.”

“However, without minimizing the harm done as a result of Epstein’s alleged misconduct, Prince Andrew never sexually assaulted Joffrey,” they added. “He categorically denies Giuffre’s false allegations against him.”

David Boyes, Joffrey’s attorney, said in a statement that Andrew’s attempt to dismiss the lawsuit “failed to address the serious allegations” it contained.

He also said that the settlement agreement “on the face of it” applies “at the most” to people involved in the primary litigation in Florida, thus excluding Prince.

“Prince Andrew’s attempt now to use the 2009 version as a prison-free card shows how desperate he is to avoid the facts of what he did,” Boyes said.

Epstein committed suicide at the age of 66 in a Manhattan prison in August 2019 while awaiting trial for sex trafficking.

Constitutional Challenge

Joffrey, 38, sued -09 Andrew damaged unspecified August, accusing him of forcing her to have sex at the London home of Ghislaine Maxwell, Epstein’s longtime classmate.

Andrew was also accused of abusing her at Epstein’s mansion in Manhattan, and on one of Epstein’s private islands in the US Virgin Islands.

In filing Friday, Andrew’s lawyers said they would also challenge a 2019 New York law that gave child sexual abuse survivors a now-closed two-year window to prosecute alleged abusers for behavior that occurred many years or decades ago.

Andrew’s lawyers said the law, which allowed Joffrey to pursue her case, deprived the prince of due process under the New York state constitution.

New York’s attorney general’s office, Letitia James, the state’s top law enforcement official, was not immediately available for comment.

Andrew has not been charged with crimes.

He has given up many royal duties and lost support from charities and organizations after a disastrous BBC interview in November 2019 in which he showed no sympathy for Epstein’s victims.

The next hearing in Joffrey’s lawsuit is scheduled for November 3.

Joffrey was sued separately for $20 million Thursday for allegedly defaming a Twitter (NYSE:) artist who said she brought women to Epstein but denied being a recruiter.

Actress Rina Oh Amin filed a lawsuit over her tweets, including that she “arranged and participated in the abuse of minors.” Amen called the tweets “maliciously false” and said Epstein abused them as well.

Maxwell, 59, has pleaded not guilty to sex trafficking and other charges for allegedly helping to recruit and prepare underage girls for the abuse of Epstein between 1994 and 2004. Her trial begins on November 29.
