While food delivery has been a saving grace for many restaurants, a class-action lawsuit claims Chick-fil-A’s actions have gone too far.

On September 28, plaintiffs Aneisha Pittman and Susan Ukpere filed a class-action complaint against the chicken chain to compensate it for its lower delivery fees by charging more for its food on delivery orders.

“On delivery orders only, Chick-fil-A rates food orders for delivery orders at a hefty 25-30%. In other words, the same order for 30-piece chicken nuggets costs roughly another $5-6 when ordered. Delivery compared to an order via the same mobile application for pickup, or when ordering in a store,” the lawsuit states.

Claims made since the start of the pandemic, “the chain has moved aggressively into the food delivery business, taking advantage of the opportunity presented by Americans’ reduced desire to leave their homes.”

The lawsuit alleges that Chick-fil-A typically promises a delivery cost of $2.99 ​​or $3.99 to differentiate itself in the competitive food delivery space. But by publicizing these costs, Chick-fil-A “gains unfair control over competitors who fairly disclose their true delivery charges.”

Based on the exponential growth in online food delivery, the sector is set to become more competitive and crowded. According to Marketwatch, the top four US food delivery apps — Doordash, Uber, Grubhub, and Postmates — saw a collective increase of $3 billion in the second and third quarters of 2020. In 2019, market research firm Frost & Sullivan claimed that online food — The delivery sector will grow to $200 billion in revenue by 2025.

The fast-food chain must respond to the lawsuit by December 6.
